Goboony – Privacy Policy

General Principles

Goboony operates an online platform and community marketplace which facilitates the rental of motorhomes through its websites www.goboony.nl, www.goboony.de, www.goboony.it, www.goboony.co.uk, www.goboony.com and any other domains that may be added in the future (jointly referred to as: “the website”). To provide and offer its services, Goboony processes certain personal data as set out in this Privacy Policy.

We encourage you to read this policy carefully before you start using Goboony's services and to regularly review this policy on changes and amendments. If you have any questions about our Privacy Policy, please feel free to contact us via our Help Centre

By registering at Goboony and using the Goboony services you consent to the collection, processing and use of your personal data as set out in this Privacy Policy.

Goboony takes your privacy seriously. Goboony therefore adheres to the data protection principles, including:

  • Goboony shall process personal data lawfully and fairly;
  • Goboony shall be transparent about all data processing;
  • Goboony shall obtain your prior consent if needed;
  • Goboony shall respect your rights of access, correction and objection;
  • Goboony shall secure your personal data.
  1. Who is Goboony and how can I contact Goboony?

    The party responsible for the processing of customer personal data via the website is Goboony, a trade name of Goboony B.V., established in Utrecht, at Lange Viestraat 2-B, 3511 BK Utrecht the Netherlands ("Goboony"). Local subsidiaries may act as data processors on behalf of Goboony.

  2. Why does Goboony process personal data?

    Goboony processes personal data in order to provide the services via its website and for the purposes described below. Your personal data is required and you entitle us to use your personal data:

    To create an account: your contact details (i.e. first name, middle name, surname, mobile phone number, e-mail full address, gender, date of birth and country) and profile picture are required to create an account with Goboony. You may, voluntary, add additional personal data to your Contact Details, such as pictures, your biography and social media links (such as Facebook and Google). Alternatively, you may decide to create an account using your Facebook/Google account, in which event Goboony processes the following data from your Facebook or Google account: information on your public Facebook/Google profile (name, profile picture, age category, gender, language, country and other specific public information), your Facebook/Google friends lists and your email address.

    To make a booking: your Contact Details and payment details (i.e. IBAN account number and account holder name and-or credit card details) are required to make a booking with Goboony, to verify if you meet the requirements (such as age category if indicated by the owner) and to process payments (“Reservation Data”). Goboony doesn’t store any credit card details.

    To list your motorhome(s) for rental: your contact details, availability of your motorhome, licence plate number of your motorhome and non-personal motorhome information are requested and processed by Goboony in order to enable you to offer your motorhome for rental via Goboony, to show availability and the location of your motorhome (Motorhome Data). Motorhome data is furthermore used by Goboony to verify if your motorhome is correctly registered on your Goboony account and is not registered stolen or missing, and to verify your identify and ownership of the motorhome. In addition to this, payment details (i.e. bank details, account number and name of your bank as well as the account holder name (as stated on the bank card) are required to process payment.

    To agree to a rental agreement: contact details of the hirer and owner, the car's license plate number, and geolocation ("Rental Data"), are required to enter into a rental agreement and into an insurance agreement. Note, in order to agree into an insurance agreement, in some countries (like Italy) Goboony shall transfer Rental Data to its insurance companies. In addition, Goboony shares the following information between the hirer and the owner: your Contact Details, Reservation data, The Rental Agreement and the Rental Data.

    Electronic communication between hirers and owners may be transferred via Goboony's servers or may be transferred by Goboony to service providers to enable to provide these services to you.

    In addition to the above, your personal data may be used for the following purposes:

    Local law compliance: to comply with applicable law, Goboony may be required to process all your personal data for other purposes than set out in this agreement, such as law enforcement and to meet valid court orders;

    Fraud detection: to prevent fraud and misuse, and to keep frauds, scammers and other criminals away, Goboony processes your personal data for fraud detection. Note, if we detect or we have reasonable grounds to believe that any fraud, scam or criminal activity is attributable to you, we will process your personal data to prevent your future use of our service.

    Support services: to provide (international) customer support we may collect and share your personal data to respond to your questions, including helping you to with any issues which may arise regarding a booking.

    Information notices: to send information notices (not being marketing communications) required to provide the services (such as system notifications and text messages an owner receives if a hirer is interested in a motorhome, or a reminder when a booking has not been confirmed or completed). Goboony may also send you information relating to a booking and a questionnaire or review form after you have made a booking.

    Communication and reviews: to allow you to communicate with other registered users, and to upload reviews and experiences, Goboony may process your name, profile picture and reviews. Goboony may post user experiences on its website providing containing limited data of its users.

    Monitoring hiring and rental behaviour: to allow hirers and users to check your hiring and rental behaviour, this data will be generated by Goboony solely on the basis of your activity and bookings, and will automatically be added to your profile, which is visible on the website to all visitors.

    Joining groups: to allow you to join groups, or receive invitations from Goboony to join groups.

    Data aggregation: to minimize the processing of personal data, Goboony may aggregate or encrypt your personal data to create anonymous data which cannot be linked to a specific person.

    Analyses and testing: to analyse how registered customers use the website and the Goboony services, to test new services and tools, and to secure, improve and optimize the website.

    Marketing: to send you marketing communications, such as newsletters, the likes of which you can opt-out at any time. To the extent permitted by applicable law, Goboony may also use your personal data to create customer profiles and send personalized advertisements. Based on the information you share with us, Goboony may show individualized offers, which may include third-party offers. Please note that you are entitled to object to the profile building and can withdraw your content to receive individualised advertising, as explained in our Cookie policy.

  3. Under what circumstances are Goboony able to disclose my personal data to third parties?

    In order to deliver our Services, Goboony will share your Contact details with Third Party service providers. With these parties we agree in a Data Processing Agreement your data will be processed with great care. These parties will only use your data when necessary, to deliver their services and not for any other purposes. These third parties use your data for: payment services, bookkeeping, hosting, data storage, communication, marketing, website optimization, user or vehicle checks, insurance solutions, or give insight into our own data. These parties are defined in legal terms as “Data Processors”.

    Competent authorities: We will share your personal data when we in good faith believe it is necessary for us to do so in order to comply with a legal obligation under applicable law, or respond to a valid legal process, such as a search warrant, a court order, prevention, detection or prosecution of criminal offenses, fraud or a subpoena.

    We also will share your personal data where we, in good faith, believe that it is necessary for the purpose of our own, or a third party’s legitimate interest relating to national security, law enforcement, litigation, criminal investigation, protecting the safety of any person, or to prevent death or imminent bodily harm, providing that we deem that such interest is not overridden by your interests or fundamental rights and freedoms requiring the protection of your personal data.

    Business partners: Goboony can integrate the services of its partners into the website or offer partners the opportunity to offer their products and services on the website, to help its business partners to market their services.

    Goboony can hand over your data to third parties in case of a company merger, company restructuring, in case of a sale or a bankruptcy. If required under applicable law, Goboony will ask for your permission in advance.

  4. How can I access my rights, view, change and delete my personal data?

    Please make sure that all personal data Goboony processes about you is correct, relevant and not excessive, such as the personal data stored on your profile page after you log in on the website. Goboony respects your rights of access, correction and objection. To exercise your rights, to be informed of the personal data Goboony processes about you, or to change, update and delete personal data, please contact Goboony at support@goboony.co.uk. Goboony will process such requests without undue delay, at least within 4 weeks of receiving such a request, or as otherwise required to by applicable law.

    If it is not clear to Goboony which personal data you wish to view, change or delete, Goboony may, without undue delay, ask you to specify your request in more detail. Goboony will suspend the processing of your request until it has received your (detailed) specification. Goboony will always send you a confirmation after your request has been processed.

    As soon as possible after receipt of your request, Goboony will stop the use of your personal data for the purposes you object to, or - in the case of a request to change or delete personal data - change or delete the relevant personal data, unless meeting such request would breach applicable law or a legitimate business interest of Goboony. Goboony shall notify you thereof in the event of this.

  5. Data retention and deletion

    We keep your personal data only as long as necessary to provide you with our Service and for legitimate and essential business purposes, such as maintaining the performance of Goboony, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal data for as long as you are a user of the Service. For example, we keep your hiring and renting history.

    If you request it, we will delete or anonymise your personal data so that it no longer identifies you, unless, we are legally allowed or required to maintain certain personal data, including situations such as the following:

    • If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;
    • Where we are required to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
    • When necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
  6. Security

    We are committed to protecting the personal data of our users. We implement appropriate technical and organisational measures in order to protect, and maintain the security of your personal data; however, please note that no system is ever 100% secure. We have implemented various policies including pseudonymisation, encryption, access, and retention policies to guard against unauthorised access and unnecessary retention of personal data in our systems.

    Your password protects your user account, so we encourage you to use a unique and strong password, limit access to your computer and browser, and log out after having used Goboony.
