GENERAL TERMS AND CONDITIONS OF SALE

Article 1 - Scope of the general terms and conditions of sale

These general terms and conditions automatically govern all sales of holidays made on the www.camping-laveniseverte.com or www.camping-laveniseverte.fr website or by telephone. They form an integral part of any contract concluded between the campsite and its customers. Each customer acknowledges having read the general terms and conditions, the internal regulations and the RGPD before booking a holiday.

In accordance with the law in force, these general terms and conditions are made available to all customers for information purposes prior to the conclusion of any contract for the sale of holidays. They may also be obtained on written request sent to the establishment's head office.

Article 2 - Booking conditions

2.1 Prices and payment

All prices are quoted in euros and include VAT. The customer's attention is drawn to the fact that tourist tax is not included in the price. All booking requests are accompanied by an initial deposit of 30% of the price quoted, together with the booking contract. On receipt, you will be sent an e-mail indicating any additional deposit and the balance of the stay to be paid on arrival for pitches or one month before arrival for rental accommodation. If this is not the case, and after a reminder by email or telephone, the holiday will be cancelled. For bookings made less than 30 days before the start of the holiday, we require full payment at the time of booking.

Bookings only become effective after receipt of the deposit and either the booking contract, duly completed and signed, or acceptance of the general terms and conditions of sale when booking online.

Our prices include access to the sanitary facilities, reception facilities, non-paying activities, aquatic area and communal areas.

Minors must be accompanied by their parents or legal guardians.

Whether it's a pitch or accommodation, given the diversity of rentals on offer, there are differences in terms of configuration, orientation, location, age (accommodation) and decoration (accommodation): we do our best to satisfy you but this does not constitute a contractual guarantee.

• Pitch bookings: the basic package includes a pitch for a tent, caravan or camper van for 2 people, electricity and water. From 1 to 8 people maximum depending on pitch category.
• Accommodation bookings: the accommodation is fully equipped (list of small items available on the website and displayed in the accommodation), with the exception of sheets, table linen and towels. The basic package is for 1 to 7 people, depending on the type of accommodation. The campsite reserves the right to refuse access to groups or families arriving in numbers exceeding the capacity of the accommodation rented. If a late arrival is not notified, the rental/pitch will become available 24 hours after the arrival date stated on the booking contract. After this time, and in the absence of a written message, the booking will be cancelled and the payment will be retained by the campsite management. All rentals are by name only and may not be transferred.
• Group bookings: any booking of more than 4 accommodations by the same individual or by different individuals who know each other and are travelling together for the same reasons on the same dates of stay is considered a group booking. The accommodation offered on our website is intended exclusively for individual customers. For all group booking requests, you must contact us by telephone, e-mail or via our 'contact us' section.

We reserve the right to examine your booking request before accepting or refusing it.

Rates: Our rates do not include an extra vehicle, extra people, pets, daily visitors, cancellation guarantee, booking fees, tourist tax, cleaning charge (€90) and optional extras (bed linen, etc.).

Our prices are subject to change according to economic and commercial conditions. Promotional offers made after the booking date are not retroactive and no refund of the difference in price will be made.

Sub-letting is totally forbidden and anyone presenting themselves will be refused access to the campsite and accommodation.

2.2 Booking changes

No reduction will be made for late arrivals or early departures.

2.3 Cancellation

A) Mobile home/chalet/ecolodge rental

- For any stay cancelled more than 30 days before the arrival date, the total amount paid will be retained by the campsite.

- For any stay cancelled within 30 days of the arrival date, for any reason whatsoever, the full amount of the stay booked will be payable and will be retained by the campsite.

B) Rental of bare pitches

- For any stay cancelled and not used, the deposit will be retained by the campsite.

2.4 Cancellation insurance

We strongly recommend that you take out cancellation insurance in order to be reimbursed for the cost of your stay (in accordance with the general terms and conditions of the insurance). This insurance is optional and represents 5% of the cost of the holiday.

- In the event of cancellation or interruption of your stay, the campsite cannot be held responsible. As a result, no refund will be made by the campsite.

- The insurance premium must be paid in full when booking your holiday and is non-refundable.

- Cancellation insurance reimburses all sums paid before the arrival of the holiday and the amount of the unused holiday pro rata temporis in the event of early return (excluding booking fees, cancellation guarantee and tourist tax).

- In the event of a claim, you must notify the company within 5 days.

The hirer must be insured for civil liability.

2.5 Right of withdrawal

The legal provisions relating to the right of withdrawal in the event of distance selling as set out in the French Consumer Code do not apply to tourist services (article L121-20-4 of the French Consumer Code).

Therefore, for any order for a stay with the campsite, the customer has no right of withdrawal.

Article 3 - Course of the holiday

3.1 Arrivals and departures

Pitches: arrivals from 12 noon and departures before 12 noon.

Rented accommodation: arrivals are from 4pm and departures before 10am, whatever the day of the week. If you notice any problems with your rental property on arrival (cleaning, utensils, etc.), please inform reception within 24 hours so that we can rectify the situation as quickly as possible. After this time, no complaint will be taken into account.

3.2 Deposit

Two deposits per accommodation will be required on the day of your arrival (by cheque or credit card imprint): €250 for the accommodation and €90 for cleaning (if you do not take the €90 package). These deposits will be returned to you a few days after your departure following the inventory of fixtures carried out by the cleaning team. If any damage and/or lack of cleaning is observed, we will be obliged to invoice you for the services provided (cleaning, repairs, breakages, etc.).

If the rental property is returned in perfect condition, the security deposits will be sent to you, torn up and photographed, by e-mail a few days after your departure.

3.3 Departure

If the accommodation key is returned after 10am or the pitch is vacated after 12 noon, an additional night will be charged. Any extension of the stay must be notified at least 24 hours before the planned departure date.

3.4 Pets

Pets are accepted for a fee payable at the time of booking, with the exception of 1st and 2nd category dogs. Animals must not be left alone in the accommodation. They must be kept on a lead at all times and are not allowed near the swimming pools or in the buildings. Vaccination certificates for dogs and cats must be up to date.

3.5 House rules

As required by law, you must adhere to our house rules below, which have been filed with the prefecture, displayed at reception and a copy of which will be given to you on request. In the event of a customer disrupting the stay of other users, in the event of physical or verbal violence, threats towards our staff or customers, or any attitude that jeopardises the safety of people and/or property, the customer will be expelled immediately.

3.6 Electric vehicles

To avoid accidents caused by the illegal charging of electric vehicles on the campsite's electrical sockets, we would remind you that our accommodation is not suitable for charging electric or hybrid vehicles. See internal rules below. Electric vehicle charging point in the car park.

3.7 Aquatic area

Please follow the rules for the pool area, which are displayed at the swimming pool. Children must be accompanied by an adult. For the sake of hygiene and safety, the following are not permitted in the pool area: long shorts, wetsuits, etc. SPA prohibited for children under 16.

3.8 Image rights .....................

The campsite may take photographs or videos and publish them on its media. Authorisation must be obtained from the persons concerned by accepting these GTCs.

Article 4 - Liability

The campsite declines all responsibility for damage to camper-caravanners' equipment caused by their own actions. Civil liability insurance for your equipment is compulsory (FFCC, ANWB, ADAC, etc.).

Article 5 - Disputes

We cannot be held responsible for fortuitous events, force majeure, climatic events, legal or administrative decisions, which may disrupt, interrupt or prevent the holiday, or cancel/modify/suppress the activities, entertainment or facilities.

Article 6 - Applicable law

These general terms and conditions are governed by French law and any dispute relating to their application shall fall within the jurisdiction of the Tribunal de Grande Instance or the Tribunal de Commerce of Niort.

Article 7 - Mediation

In accordance with the provisions of the French Consumer Code concerning 'the mediation process for consumer disputes', the customer has the right to have recourse free of charge to the mediation service offered by La Venise Verte campsite. The mediator proposed is CMC2, 'Le Centre de médiation de la consommation de conciliateurs de justice'. INTERNAL REGULATIONS

1. Conditions of admission and stay : To be admitted to enter, settle or stay on the Venise Verte campsite, you must have been authorised to do so by the manager or his representative. It is the manager's duty to ensure that the campsite is kept in good order and that the present internal regulations are complied with. Staying on the campsite implies acceptance of the provisions of these rules and a commitment to comply with them. No-one may take up residence on the campsite. For obvious safety reasons, the campsite reserves the right to refuse entry to minors unaccompanied by adults.

2. Police formalities: Minors unaccompanied by their parents will only be admitted with written authorisation from their parents and must be supervised by an adult. In application of article R. 611-35 of the Code de l'Entrée et du Séjour des Etrangers et du Droit d'Asile (Code on the Entry and Residence of Foreigners and the Right of Asylum), the manager is required to have foreign customers complete and sign an individual police form on arrival. This must include the following information surname and first names; date and place of birth; nationality; usual place of residence. Children under the age of 15 may appear on the form of one of their parents.

3. Installation: The outdoor accommodation and related equipment must be installed in the location indicated in accordance with the instructions given by the manager or his representative. TV cables, extension leads and adapters are not supplied. The reception can lend you equipment subject to availability. No installation (tent, etc.), vehicle or additional person is accepted on the pitch or accommodation without the agreement of the campsite.

4. Reception office: Open out of season from 9am to 12.30pm and from 2pm to 6pm. In season from 8.30am to 12.30pm and from 2pm to 7pm minimum (from April to September).

At the reception desk, you'll find all the information you need about the campsite's services, grocery shops, sports facilities, tourist attractions in the surrounding area and other useful addresses. A system for collecting and handling complaints is available to customers.

5. Payment : Payments are made at the reception desk. The amount is set according to the current tariff displayed at the entrance to the campsite and on the website. An estimate will be issued on request. Invoices are due according to the number of nights spent, counted from midday to midday for pitches and from 4pm to 10am for accommodation. Customers booking a pitch must pay the balance of the invoice on arrival and no later than the day before departure. Accommodation customers must pay their bill one month before arrival.

6. Display: These rules and regulations are displayed at the entrance to the campsite and at the reception desk. They will be given to any customer who requests them.

In the case of classified campsites, the classification category and the number of tourism or leisure pitches are displayed. The prices of the various services are communicated to customers under the conditions laid down by order of the Minister for Consumer Affairs and can be consulted on our notice boards.

7. Departure arrangements: Customers staying on a pitch are asked to inform the reception office of their departure the day before. Customers intending to leave before the reception desk opens must pay for their stay the day before.

8. Noise and silence: Guests are asked to avoid any noise or chatter that might disturb their neighbours between 10.30 pm and 8.30 am. Sound equipment must be adjusted accordingly. Doors and trunks must be closed as discreetly as possible. No motorised traffic is permitted between 10.30pm and 8.30am. Parking is available at the campsite entrance. The campsite manager ensures the peace and quiet of his customers by setting times when there must be complete silence (from 10.30pm to 8.30am).

We cannot be held responsible for emergency work undertaken by the campsite, by public authorities or by a private individual in the vicinity, which could disturb our customers on the campsite.

9. Services: The campsite may have to close a play area or other communal area (swimming pool, etc.) from time to time in the event of a technical problem that could lead to a lack of safety or hygiene for customers. Please note that at the beginning and end of the season, certain services or activities may be closed (please ask for details). We are also not responsible for the unexpected departure or absence of an employee. The management will do its utmost to make up for any staff shortages, but cannot be held responsible.

10. Visitors: After being authorised by the manager or his representative, visitors may be admitted to the campsite under the responsibility of the campers receiving them. The customer/vacitor may receive one or more visitors at reception. The campsite's services and facilities are accessible to visitors. However, use of these facilities is subject to a charge according to the rates displayed at the entrance to the campsite and at the reception desk. Visitors' cars are not allowed on the campsite. Visitors must leave the campsite by 10.30pm. Access to the swimming pool is strictly forbidden to all visitors unless they pay the daily 'visitor' rate.

11. Pets: Pets are accepted provided they are calm, tattooed, vaccinated and kept on a lead. Maximum 2 animals per pitch. Only category 3 dogs are allowed. Pet owners must keep their pets clean and pick up after them. Dogs and other animals must never be allowed to run at large. They must not be left unsupervised on the campsite, even locked up, in the absence of their owners, who are civilly responsible for them - this also applies to rental accommodation. Your pet must not cause any nuisance (noise or other) for the well-being and respect of other campsite guests. Pets are subject to an additional charge.

12. Vehicle traffic and parking: Within the campground, vehicles must travel at a speed limited to 10km/h. Traffic is allowed from 8:30 to 22:30. Only vehicles belonging to the campers staying at the campsite may drive through the campsite. Parking is strictly prohibited on the sites usually occupied by accommodation unless a parking space has been provided for this purpose. Parking must not obstruct traffic or prevent new arrivals from moving in. Parking is available at the entrance to the campsite. The Management declines any responsibility in case of damage, breakage or theft within the campsite.

13. Maintenance and appearance of the facilities: Everyone is obliged to refrain from any action that could affect the cleanliness, hygiene and appearance of the campsite and its facilities, including sanitary: Rinse with the squeegee after showering and brush in the toilet if necessary. It is forbidden to throw sewage on the ground or in the gutters. Camping-carers and caravanners must empty the waste water in the facilities provided for this purpose (at the entrance of the campsite). Washing of vehicles and bicycles is prohibited. Household garbage, waste of any kind and paper must be deposited in the sorting bins at the entrance to the campsite. Interventions on repairs in accommodation are possible with your consent.

Washing clothes is strictly prohibited outside the containers provided for this purpose in the sanitary block. The clothes will be dried in the laundry dryer. However, it is tolerated close to the accommodation, provided that it is discreet and does not disturb the neighbors. It should never be made from trees.

Planting and floral decorations must be respected. Mowing possible on your site during stay. It is forbidden to plant nails in trees, to cut branches, to make plantations. It is not permitted to demarcate the location of a facility by personal means, nor to dig the ground. Any damage to vegetation, fences, grounds or campsite facilities shall be the responsibility of the person making the repair. The space that has been used during the stay must be maintained in the state in which the camper found it when entering the premises. Drinking water is a valuable resource, please conserve it. Please report any water leaks.

14. Safety: Children are under the responsibility and supervision of their parents or responsible adult throughout the campsite.

a) Fire: Open fires (wood, coal, etc.) are strictly prohibited. Approved stoves or barbecues must be maintained in good working order and not used under hazardous conditions. In the event of a fire, notify Management immediately. Fire extinguishers are available if necessary. Any additional electrical equipment must be validated before arrival with the campsite manager.

(b) Theft: The Directorate is responsible for items left at the office and has a general duty to monitor the campground. The camper remains responsible for its own installation and must report to the Manager the presence of any suspicious person. Customers are advised to take the usual precautions for safeguarding their equipment.

c) Limited speed: For all travel, please use the designated lanes and follow the signs, 10 km/h.

d) Electric vehicles: In order to avoid serious accidents caused by the illegal charging of electric vehicles on camping outlets, we remind you that our accommodations are not suitable for charging an electric or hybrid vehicle. Our insurance does not cover any damage that would be caused by the charge of a vehicle. The entire claim is fully and exclusively borne by the owner of the vehicle. For these reasons and for your safety, it is strictly FORBIDDEN to recharge the battery of an electric or hybrid vehicle by plugging it into a socket in an accommodation or any other electrical outlet on the campsite. In case of infringement, we charge an amount of 100 €.

An electric or hybrid vehicle charging station is available at the reception car park (extra charge).

e) Aquatic area: In the aquatic area, the wearing of swimming trunks is mandatory. Food, cigarettes and alcohol are strictly prohibited. The jacuzzi is accessible to people over 16 years old and forbidden to pregnant women, sensitive or fragile people. We remind you that the aquatic area can be dangerous and that the customer will be liable in case of non-compliance with the swimming pool regulations posted at the entrance and inside the aquatic area. Toddlers must wear diapers specially designed for swimming and those who do not know how to swim must wear braces. All minors must be accompanied by a parent or responsible adult. Access to the pool is prohibited outside opening hours. Access to the aquatic area only by holidaymakers, visitors must present themselves at the reception and pay the visitor rate per day. Shower required upon arrival.

f) The Management has a general duty to monitor the campsite. In the event of an emergency outside reception hours, ring the bell at reception, go to the restaurant or call 05 49 35 90 36. An emergency first aid kit is available at the reception desk along with a defibrillator.

15. Games: No violent or embarrassing games may be organized at the campsite. The facilities (toilets, restaurant, bar, swimming pool...) can not be used for games. Children must always be under the supervision of their parents or responsible adult and accompanied in sanitary facilities and common areas.

16. Dead Garage: Unoccupied equipment may be left on the land, only with the agreement of the Management and only at the indicated location. This service is for a fee. Management is not responsible for equipment left in the garage.

17. Violation of the rules of procedure: In the event that a resident disrupts the stay of other users or does not comply with the provisions of these rules, the manager or his representative may orally or in writing, if he deems it necessary, to put the Prime Minister on notice to cease the disturbances.

In the event of a serious or repeated breach of the rules of procedure and after the manager has given notice to comply with them, he may terminate the contract.

In the event of a criminal offence, the manager may call on law enforcement. The manager is responsible for the order and good behaviour of the campsite, he has the duty to sanction serious breaches of regulations and if necessary to expel their perpetrators.

18. Right to image: For the advertising needs of the campsite, you authorize, and without compensation, Camping la Venise Verte to use on all media photos and videos of you, your children or personal property that could be taken during your stay. In accordance with the data protection law, you have a right of access, rectification and opposition to your personal data. For this, it is sufficient to make a written request with the campsite.

19. Damages: All voluntary or involuntary damages will be subject to a repair bill and will be charged to the customer, through his insurance or not. It is recalled that children are under the responsibility of their parents or responsible adult.

20. Insurance: The campsite declines all responsibility in case of theft, fire, natural events, natural disasters, cases of force majeure, power cuts from the electricity supplier and in case of incident under the responsibility of the customer, and will not bear the cost of the damage. 21. Claim: The person in charge must maintain order and proper conduct of the camp. It has a duty to sanction serious breaches of the regulations and, if necessary, to expel the perpetrators. We invite you to make your complaints at the reception. They will be taken into consideration if they are dated, signed, as accurate as possible and relate to recent events. No brochure and website can be safe from possible misstatements, omissions or printing errors. Only the rental contract confirming the reservation is a contractual document.
