GENERAL TERMS AND CONDITIONS OF SALE + STAY AND RENTAL CONDITIONS

This working document brings together two separate contractual documents in one file. Their content and purpose remain distinct: the General Terms and Conditions of Sale govern the commercial relationship and booking; the Stay and Rental Conditions specify the practical arrangements for the stay and the use of camping pitches and rental accommodation.

GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in connection with the booking and sale of stays on camping pitches and/or in rental accommodation at Camping Les Hauts de Rosans.
By making a booking, the customer acknowledges having read and accepted these GTC.

1. SERVICES AND PRICES

1.1. Camping pitches
The campsite offers pitches for tents, caravans and motorhomes.
The price of the stay is calculated according to the package selected. The package necessarily includes rental of the pitch, accommodation for 2 people, and the installation of a tent with one vehicle, or a caravan with one additional vehicle, or a motorhome, or a converted van. It also includes access to reception facilities, activities and sanitary facilities and, depending on the package selected, an electricity connection and/or other services.

• Comfort Package: includes electricity.
• Privilege Package: Comfort Package + water supply + wastewater drainage.
• Premium Package: Privilege Package with a pitch equipped with private sanitary facilities including a toilet, washbasin, shower and dishwashing sink.

Additional charges (extra persons, up to a maximum of 4 additional persons, extra tent, extra vehicle, pets, visitors, etc.) are not included in the packages and are charged separately.

1.2. Rental accommodation
Prices include rental of the accommodation according to its capacity and the number of people booked, water, gas and electricity charges, excluding charging of an electric or hybrid vehicle battery, as well as parking for one vehicle and access to reception facilities, activities and sanitary facilities.

1.3. Security deposit
A security deposit is required for any rental of accommodation, private sanitary facilities or equipment.
It is taken as a bank-card pre-authorisation (secure P.L.B.S. procedure – Payment for the Rental of Goods and Services) on the customer's arrival.
It may cover, in particular, costs arising from damage found in the accommodation, its contents or equipment provided, as well as cleaning costs if the accommodation is not returned in the expected condition at departure. If no justified deduction is made, the pre-authorisation is automatically released within a maximum of thirty (30) days after it is set up.

1.4. General provisions
Prices are stated in euros, inclusive of all taxes, and do not include the tourist tax or eco-tax, which must be paid with the balance of the booking.
Prices may change depending on economic and commercial conditions. The contractual price payable is the one shown on the booking confirmation. Flower Campings applies dynamic pricing: rates may therefore increase or decrease.
Partner benefits and promotional offers are not retroactive and cannot be applied to a booking that has already been confirmed, whether paid in full or in part.

2. BOOKING CONDITIONS

2.1. Booking procedure
Bookings may be made on www.camping-hautsderosans.com, www.flowercampings.com or by telephone.
Any booking request must be accompanied by payment of a 30% deposit on the total price, inclusive of tax, of the stay, including the price, inclusive of tax, of the services booked and, where applicable, payment of the cancellation insurance premium if such insurance is taken out.
A booking becomes contractually binding only when the customer receives written confirmation by email summarising the details of the stay.
The balance must be paid no later than 30 days before the start of the stay. Failing this, the booking will be considered cancelled and the cancellation conditions below will apply.
Any booking made less than 30 days before the arrival date must be paid in full at the time of booking, unless more favourable terms have been communicated to the customer.

2.2. No right of withdrawal
In accordance with Article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services other than residential accommodation when they are to be provided on a specific date or during a specific period.

2.3. Maximum capacity
For safety and insurance reasons, the number of occupants must not exceed the capacity specified for the accommodation or pitch booked, including newborn babies. If this capacity is exceeded on arrival, the campsite reserves the right to refuse access to the accommodation or pitch without a refund.

2.4. Customers – Minors
For safety reasons, minors who are not accompanied by their parents or grandparents throughout the stay are not accepted, unless prior written authorisation has been granted by the campsite upon request.

3. PAYMENT TERMS

3.1. Payment methods
Payments may be made in euros by French bank or postal cheque, Chèque-Vacances Connect, cash, bank card (CB, Visa, Mastercard) or bank transfer. Bookings made less than 30 days before the start of the stay must be paid exclusively by bank card.
Paper ANCV Chèques-Vacances are not accepted for payment of the deposit. They may be used to pay the balance of a stay in accordance with the arrangements communicated by the campsite: a bank cheque for the amount of the balance must be sent at least 30 days before the start of the stay and will be exchanged on arrival for the paper vouchers.
Paper ANCV Chèques-Vacances must first be completed with the beneficiary's name and address on the lines provided.

3.2. Walk-in customers
For stays on a pitch without a prior booking, the first night must be paid for on arrival. The customer must inform reception of the intended or extended length of stay. The balance must be paid no later than the day before departure, taking reception opening hours into account.
No refund will be made in the event of early departure.

4. CHANGES TO THE STAY
Any request to change the dates and/or arrangements of the stay (including the type of accommodation) must be sent by email at least 21 days before the original arrival date. The new stay must be booked during the same season as the original stay, subject to availability and the rates in force. Only one change is permitted. If the new stay costs more, the difference must be paid no later than 30 days before the new arrival date. Otherwise, the new stay will be considered cancelled. If the new stay costs less, the price difference will be retained by the campsite. If the amended stay ultimately cannot be honoured, it will be considered cancelled and the sums paid will not be refunded.

5. CANCELLATION OF THE STAY

5.1. Cancellation by the customer
Any cancellation must be notified in writing on a durable medium (email, registered letter with acknowledgement of receipt, etc.).
More than 30 days before arrival: the deposit, booking fees and, where applicable, the cancellation insurance premium remain payable to the campsite.
Between the 30th and 15th day before arrival: the deposit, booking fees and, where applicable, the cancellation insurance premium remain payable to the campsite; the balance is converted into a credit voucher that can be used for another stay at the campsite, booked during the same season or the following season.
Less than 15 days before arrival: all sums paid remain payable to the campsite.
Taking out cancellation or stay-interruption insurance when booking is recommended.
“Campez Couvert” insurance applies in accordance with its own terms and conditions.

5.2. Cancellation by the campsite
If the campsite has to cancel a confirmed booking, it will inform the customer by email as soon as possible. All sums paid will be refunded in full no later than fifteen (15) days after notification of the cancellation.

6. UNAVAILABILITY OF SERVICES
The services and facilities offered (swimming pool, restaurant, activities, entertainment, etc.) may be unavailable during all or part of the stay, in particular due to weather conditions, technical constraints, works or force majeure. The campsite will make every reasonable effort to inform customers of planned works or improvements.

7. TERMINATION OF THE CONTRACT IN THE EVENT OF MISCONDUCT
The booking contract may be terminated automatically in the event of repeated failure to comply with the internal rules, after formal notice to comply with those rules, or if the customer fails to arrive within 24 hours of the start of the stay without providing justification or contacting the campsite.
If the contract is terminated because of repeated failure to comply with the internal rules, the customer must leave their accommodation or pitch within three (3) hours of notification of termination. No refund will be made.
If the customer does not arrive within the 24-hour period, the campsite may reallocate the accommodation or pitch and retain the sums paid.

8. COMPLAINTS – DISPUTES – MEDIATION
Any complaint relating to the stay must be made in writing and sent to the campsite as soon as possible, so that action can be taken during the stay where possible. Customers are encouraged to report any issue to reception immediately if it can be observed on site.
In the event of a dispute, after a prior complaint has remained unresolved, the consumer may use the services of the consumer mediator appointed for the campsite, free of charge and under the conditions set out in the French Consumer Code.

9. PERSONAL DATA
The processing of personal data carried out for booking purposes is governed by Flower's Personal Data Protection Charter, available on our website.

10. FINAL PROVISIONS
Printing or content errors may occur. We make every effort to provide photographs and illustrations that give customers an overview of the services and accommodation/pitches offered. These photographs and illustrations are intended to give an idea of the category of services. Given the variety of our accommodation and pitches, our websites provide general descriptions and photographs for illustrative purposes only. Please contact us or the campsite directly for further information. Accommodation floor areas are approximate and provided for guidance only. We reserve the right to amend or supplement all or part of these General Terms and Conditions of Sale at any time. In that case, the new version of the GTC will be available on the website with its effective date.

DOCUMENT 2
STAY AND RENTAL CONDITIONS
Camping pitches and rental accommodation • 2027 Version

These conditions set out the practical arrangements for the stay and the specific conditions applicable to the use of camping pitches and accommodation at Camping Les Hauts de Rosans. They supplement the General Terms and Conditions of Sale (GTC) and the Internal Rules.

PART A — GENERAL PROVISIONS

1. ARRIVAL AND DEPARTURE

Camping pitches (including Premium pitches)

• Arrival: from 3:30 p.m.
• Departure: no later than 12:00 noon, unless otherwise specified by the campsite.

Rental accommodation

• Arrival: from 5:00 p.m., unless otherwise stated on the booking confirmation.
• Departure: no later than 10:00 a.m., unless otherwise stated on the booking confirmation.

Customers must complete arrival and departure formalities in accordance with the arrangements communicated by the campsite.

2. ARRIVAL OUTSIDE RECEPTION HOURS
Any arrival outside normal reception hours (until 7:00 p.m.) must be notified to the campsite in advance. Where possible, the campsite will provide instructions for accessing the site and taking possession of the pitch or accommodation.

3. OCCUPANCY DURING THE STAY
The pitch or accommodation is reserved for the number of people stated in the booking and may not exceed its maximum capacity.

• Any additional person must be declared to the campsite before arrival and is subject to the applicable conditions and rates.
• Visitors are subject to the campsite's reception and safety rules.
• The booked pitch or accommodation may not be transferred, sublet or made available to a third party, whether for payment or free of charge, without the campsite's prior consent.

General rules on conduct, quietness, traffic and use of facilities are set out in the Internal Rules.

4. CONDITION REPORT / TAKING POSSESSION
On arrival, the customer takes possession of the pitch or accommodation in the condition indicated by the campsite.
For rental accommodation, customers are asked to check the general condition, cleanliness and inventory on arrival.
Any defect, damage, lack of cleanliness or missing item must be reported to the campsite in writing within twenty-four (24) hours of arrival, so that action can be taken during the stay where possible.

5. SECURITY DEPOSIT

Rental accommodation + Premium private sanitary facilities
A security deposit is required on arrival in the form of a bank-card pre-authorisation, using the secure procedure established by the campsite. The applicable amount is the one stated at the time of booking or communicated before arrival.
The security deposit may cover, in particular, damage, breakages, missing items, damage to equipment provided, and cleaning or restoration costs if the accommodation is not returned in the expected condition.
Any deduction will be justified by the nature and amount of the costs incurred or required to restore the accommodation. If no justified deduction is made, the pre-authorisation will be released in accordance with the bank's procedures and no later than thirty (30) days after it is set up.

Equipment rental
A security deposit is required for all equipment rentals.

Camping pitches
No security deposit is required for camping pitches.

6. DEPARTURE AND RETURN OF THE ACCOMMODATION

Rental accommodation

• The accommodation must be vacated no later than 10:00 a.m., unless otherwise specified.
• It must be tidied and returned in a condition comparable to that found on arrival, allowing for normal use.
• Dishes must be washed and put away, rubbish bins emptied and personal belongings removed.
• Furniture and equipment must be put back in their original places.
• Keys and other access devices must be returned in accordance with the instructions provided by the campsite.

Camping pitches

• The pitch must be vacated no later than the scheduled departure time.
• Equipment, waste and personal belongings must be removed.
• The pitch must be left clean and free of all items.

PART B — SPECIFIC CONDITIONS FOR CAMPING PITCHES

7. TYPES OF PITCHES
Subject to availability and the services stated at the time of booking, the campsite offers different types of pitches:

• Comfort
• Privilege
• Premium

8. PITCH FEATURES
The features of each pitch are those stated at the time of booking. Depending on the category, they may include:

• an area suitable for setting up camping equipment;
• an electricity supply;
• a water point;
• wastewater drainage;
• private sanitary facilities for pitches offering this service.

The services actually included are those stated on the booking confirmation.

9. SETTING UP
All equipment must remain within the boundaries of the allocated pitch and must not obstruct neighbouring pitches, access roads or campsite facilities.

• Equipment must be set up securely and used for its intended purpose.
• Vehicles and additional equipment are subject to the campsite's conditions and, where applicable, its rates.
• Any special installation or additional equipment must be reported to the campsite when requested.

Safety, traffic and quietness rules applicable throughout the campsite are set out in the Internal Rules.

10. ELECTRICITY
The available electricity supply depends on the category of pitch booked. Customers must use connections and equipment in accordance with their intended purpose and the available power.

• Connections must be made using suitable equipment in good condition.
• Any connection posing a risk to people or facilities may be refused or disconnected.
• Electric or hybrid vehicles may be charged only at the designated charging stations and in accordance with the campsite's conditions.

11. VEHICLES AND PARKING
Parking is limited to the arrangements provided for the pitch booked. One (1) vehicle may be parked on the pitch where this is permitted.
Visitor parking and the general traffic rules within the campsite are governed by the Internal Rules.

PART C — SPECIFIC CONDITIONS FOR RENTAL ACCOMMODATION

12. PROVISION OF ACCOMMODATION
The accommodation made available is the one identified on the booking confirmation, for the period, capacity and services specified therein.
The campsite offers various types of rental accommodation. Furniture, equipment and capacity may vary depending on the model booked.

13. USE OF ACCOMMODATION
The accommodation, its furniture and equipment must be used carefully and for their intended purpose.

• The number of occupants must not exceed the accommodation's maximum capacity, including newborn babies.
• Equipment and installations must not be moved, dismantled or used for purposes other than those intended.
• Mattress and pillow protectors provided must not be removed.
• Any breakage, damage, deterioration or missing item must be reported promptly to reception and may be charged for or deducted from the security deposit.

The rules governing conduct and life at the campsite are set out in the Internal Rules.

14. INVENTORY
Customers must check the inventory and the condition of the equipment provided as soon as they arrive.
Any missing, broken or damaged item must be reported within twenty-four (24) hours of arrival.
If no report is made, items may be considered to have been present and in good condition at the start of the stay, subject to the campsite's findings.

15. CLEANING
Cleaning is the customer's responsibility unless cleaning is included in the booking or the customer purchases a cleaning package.
If no cleaning package has been purchased, the customer must, in particular:

• wash, rinse and dry the dishes and leave them on the table;
• clean kitchen equipment and surfaces;
• empty and clean the refrigerator, then leave it in the position specified for departure;
• clean the bathroom and toilets;
• sweep and wash the floors;
• clean tables, chairs, worktops and surfaces used;
• empty rubbish bins and take the bags to the designated containers;
• remove sheets if linen has been rented and follow the instructions for returning the linen.

The cleaning package covers standard cleaning of the accommodation. It does not relieve customers of the obligation to clear and tidy the accommodation, wash and put away dishes, empty rubbish bins or carry out any specific tasks requested before departure.
Unusual dirt, significant spills or cleaning requiring special restoration work are not included in the cleaning package. If additional cleaning or restoration is required because of the condition in which the accommodation is left, charges may be applied and, where applicable, deducted from the security deposit.

16. DAMAGE AND LOSS
Any breakage, loss, missing item or damage to furniture, dishes, equipment or facilities provided may be charged for.
For items for which the campsite has set a replacement price, the amount communicated to the customer will apply. For higher-value equipment or materials, the corresponding replacement or repair cost may be charged based on the replacement price or the supplier's price.
Where applicable, these costs may be deducted from the security deposit.

17. KEYS
Keys and other access devices provided to the customer must be kept safe and returned on departure in accordance with the instructions provided.
Any loss, failure to return or damage may result in charges for replacement, duplication or, where necessary, security measures.

18. SPECIFIC EQUIPMENT
Specific equipment in certain accommodation units, including air conditioning, dishwashers, planchas or any other special equipment, must be used for its intended purpose and in accordance with the instructions provided by the campsite.
Any specific conditions or rates applicable to certain equipment or services are those stated at the time of booking or communicated by the campsite.

19. LATE ARRIVAL AND EARLY DEPARTURE
If arrival is delayed or departure takes place before the dates stated on the booking confirmation, the full stay remains payable. No refund or reduction will be granted for any part of the stay not used, in accordance with the GTC.

20. CONTRACTUAL DOCUMENTS
These Stay and Rental Conditions must be read together with the General Terms and Conditions of Sale.
The GTC set out, in particular, the commercial and financial conditions of the booking. This document specifies the practical arrangements for the stay and the specific conditions for using pitches and accommodation. The Internal Rules set out the general rules of conduct, safety, behaviour and use of the campsite's facilities.
In the event of any contradiction, the specific provisions stated on the booking confirmation take precedence for matters relating to the stay booked, including dates, the type of pitch or accommodation and priced services.
