Article 1. Scope of the General Terms and Conditions of Sale
These general terms and conditions transmitted to the Client form a contractual framework and constitute the entirety of the contractual relations between the Campsite and its Clients. This framework governs the sale of stays by the Campsite and is valid at the time the order is placed, to the exclusion of all other conditions. The Campsite reserves the right to modify its general terms and conditions at any time. However, the version applicable to the Client is the one accepted at the time of reservation.

Article 2. Acceptance of the General Terms and Conditions of Sale
The Client is deemed to accept these General Terms and Conditions of Sale without reserve, in accordance with the provisions of Article 1126 of the French Civil Code. The Client is therefore fully informed that by checking the box 'I acknowledge that I have read and accepted the General Terms and Conditions of Sale' when placing an order online, or upon receipt of the reservation confirmation email to which these conditions are attached, they manifest their specific, free, and informed consent, particularly regarding the use of personal data. This unreserved acceptance is valid both for the Client and for any person participating in the stay. These General Terms and Conditions of Sale are also available on the Campsite's website and at the Campsite Reception.

Article 3. Reservation
3.1 Reservation Conditions
Booking method – The Client can make a reservation online, by telephone, or directly at the Campsite.
Mobile home capacity – 4/6 person capacity mobile homes can only be rented for a maximum of 4 people.
Validation of the reservation – Any reservation request is considered final once it is accepted by the Campsite. The Campsite is entirely free to refuse it based on availability or any circumstance likely to affect the planned stay.
Acceptance of the reservation is materialized exclusively by the sending of a reservation confirmation via email, mail, or by hand delivery.
To be validated, any reservation must also be accompanied by a payment including:

• A deposit (arrhes) of 30% to 100% of the total amount of the stay depending on the reservation date;
• In the event of a 30% deposit paid at the time of reservation, the balance must be paid 15 days before the start date of the stay.
• Booking fees (covered by us thanks to the Reservation Advantage Pack); Booking fees (€20) are neither deductible from the invoice nor refundable in the event of cancellation.
• Any fees for subscribing to a cancellation/interruption insurance policy.

Electronic signature applicable to online sales – The online provision of the client's credit card number and the final validation of the order will constitute proof of the client's agreement for the demanding of sums due under the reservation, as well as signature and express acceptance of all operations carried out.
Capacity and participants in the stay – The reservation is nominative. The Client must be over 18 years of age, participate in the reserved stay, and legally provide the last names, first names, and dates of birth of all participants, including minors and newborns. The Campsite reserves the right to refuse any person not registered at the time of reservation. Any incorrect information may lead to the cancellation of the stay. Due to the nominative nature of the reservation, it cannot be transferred or sub-let, in whole or in part, without the prior, written, and express agreement of the Campsite. For safety and insurance reasons, the maximum number of occupants specified for each type of accommodation/pitch, as described in the brochure and on the website, must be strictly respected. The Campsite will refuse access to any person exceeding this capacity (including newborns), with the exception of occasional visitors invited by the Client for the day.
Groups – The Campsite offers family-oriented stays, as the accommodations are specifically designed for this purpose. The Campsite reserves the right to refuse any reservation that does not match the reception and accommodation capacities offered. The Campsite considers that any reservation(s) of 4 or more rental accommodations / pitches made by the same natural person, or by different natural persons who know each other and travel together for the same reasons on the same dates, constitutes a group. All group reservation requests must be sent by email to contact@campingcalmeetnature.com or by phone at +33 (0)4.92.83.61.57 (price of a local call depending on your operator), specifying that it is a group reservation request. The Campsite reserves the right to review the request before accepting or refusing it.

3.2 Important Information
Admission of minors – For obvious safety reasons (evacuation of the Campsite in the event of an alert…) and health reasons (hospitalization…), minors unaccompanied by their legal administrators, within the meaning of Article 389 of the French Civil Code, are not admitted. Furthermore, the Campsite is not authorized, within the meaning of Decree 2002-883 of May 3, 2002, to provide collective or individual stays away from the family home for minors under 18 years of age who are not accompanied by one of their legal administrators. Minors accompanied by their legal administrators are under the sole responsibility of the latter and must under no circumstances be left unattended within the Campsite grounds.
Non-contractual nature of communication materials – Any document other than these General Terms and Conditions of Sale, including catalogues, brochures, advertisements, and notices, is for information and indicative purposes only, and is non-contractual. Maps and photos of the rental accommodations are provided for illustrative purposes. The layout and characteristics of the rooms may vary from one model to another. Please refer to the written description of the layout available under the accommodation section of the Campsite's website to know the exact composition of each rental accommodation. For any questions, we are at your disposal at +33 (0)4.92.83.61.57 (price of a local call depending on your operator).
Campsite facilities and services – It may happen that certain services and facilities offered by the Campsite (directly or through service providers), such as Wi-Fi, television, bakery service, or bar/snack, appearing in the description, are removed, notably for weather reasons or in cases of force majeure, or do not operate, particularly during the early and late season. The Campsite's liability cannot be held engaged. The Campsite will inform the Client of any works / hazards / developments undertaken during the stay.

Article 4. Prices
The applicable prices are those indicated at the time of reservation by phone, on the internet, or at the Campsite. They are subject to change during the season and are expressed in euros, VAT included. Any subsequent change in the applicable VAT rate, occurring between the time the rates were determined and the billing of the stay, will result in a proportional modification of the price including VAT, which the Client accepts without reserve.
The price includes: • The rental of the pitch or equipped accommodation as defined in the brochure and on the websites; • Water, gas, and electricity consumption (except for pitch rentals where electricity is optional); • Access to the Campsite and its equipment / facilities, as defined in the brochure and on the website; • A parking space for one car per rental (the space is not necessarily located on the rented pitch).
The price does not include: • Booking fees; • Various taxes; • Paid services offered by the Campsite to be settled on site; • Supplements such as cleaning fees and rental of household linen or fridges for pitches; • Security deposits (caution); • Cancellation / interruption insurance; • Optional equipment (fridge, electricity and/or European plug on pitches, and rental of ready-to-camp tents and Moorea tents).

Article 5. Payment Terms and Methods
5.1 The reservation becomes effective upon receipt of your deposit (arrhes), amounting to 30% of the cost of your stay or 100% of the stay depending on the reservation date.
Payment methods for the deposit include check in euros (payable to 'GCPI Camping Calme et Nature', sent by registered mail with acknowledgment of receipt), credit card, bank transfer, and holiday vouchers (Chèques-Vacances sent by registered mail with acknowledgment of receipt) / Chèques-Vacances Connect.
If paying the deposit by check in euros or by holiday vouchers, it must reach us no later than 10 days following the reservation date.
If paying the deposit less than 30 days before the arrival date, it can be made by credit card, bank transfer, or Chèques-Vacances Connect.
In the absence of full payment on the agreed date, the Campsite is entitled to consider that the Client has cancelled their reservation and will retain any sums already paid.

5.2 Details on credit card payments
Credit cards accepted are those from the Carte Bleue, Visa, and Eurocard/Mastercard networks. American Express is not accepted. The transaction is immediately debited from the Client's credit card after verification of its data. In accordance with Article L.132-2 of the French Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By communicating their credit card information online or by phone, the Client authorizes the Campsite to debit their credit card for the amount of the deposit or the entirety of the stay. To this end, the Client confirms that they are the holder of the credit card to be debited and that the name appearing on the credit card is indeed theirs. In the event of fraudulent use of the credit card, the Client is invited, as soon as this use is noticed, to contact our reservation center at +33 (0)4.92.83.61.57 (price of a local call depending on your operator).

Article 6. Services Not Included in the Price
6.1. Booking fees – Booking fees are due per nominative file. These fees are set by the Campsite at the time of reservation. They are due at the time of reservation and are non-refundable.
6.2. Tourist tax – The tourist tax is collected on behalf of the municipalities and must be paid at the campsite. Its amount, determined per person and per day, varies depending on the destination and could be modified during the year.
6.3. Cleaning fees – The Client can request that the departure cleaning be carried out by the Campsite for a flat cleaning fee, which varies according to the range of the mobile home or chalet. Cleaning fees do not include washing dishes and kitchen utensils, and trash must be thrown away.
6.4. Security deposit (caution) – For any stay within the Campsite, a security deposit of €100 for pitches (in the event of refrigerator rental) and €150 or €200 for rental accommodations will be requested at the latest on the day of arrival at the Campsite. Payment can be made by credit card. This deposit will be returned in full BETWEEN 48H AND 72H AFTER THE CLIENT'S DEPARTURE, following a cleaning check and a satisfactory inspection of the equipment. Otherwise, the security deposit will be partially or fully withheld depending on the state of the accommodation and its equipment. Damage exceeding the sum paid as a security deposit will be charged to the Client after deduction of the security deposit. In the event of a cash security deposit, and if the Client wishes to have the amount returned immediately upon departure, it is their responsibility to make an appointment no later than the day before their departure to carry out a checkout inspection of their accommodation.
6.5. Guarantee of a specific pitch – Pitches are allocated by the Campsite based on availability, in order to optimize schedules. This allocation may be modified at any time before the actual handing over of the keys. Only the location, dates, and type of accommodation are guaranteed.
6.6. Cancellation / interruption insurance – Cancellation and interruption insurance is offered to the Client on an optional basis. It can be contracted at the time of reservation and is directly underwritten by the Company with: Gritchen Tolède & Associés - Société de courtage en assurances (HEAD OFFICE: 27 Rue Charles Durand - CS 70139 - 18021 BOURGES Cedex - France). It is non-refundable in the event of cancellation. All guarantees are detailed in the General Insurance Conditions and the insurance product information document (available upon request).

Article 7. Right of Withdrawal
The Client is informed that, pursuant to Article L. 121-20-4 of the French Consumer Code, the sale of accommodation services provided on a specific date or according to a specific periodicity is not subject to the provisions relating to the withdrawal period applicable to distance selling. Therefore, no right of withdrawal applies to stays sold by the Campsite. However, this exception does not apply to any optional insurance policies underwritten (14-day period in accordance with and within the framework of legal provisions).

Article 8. Modification of the Reservation / Stay
Any request for modification must be made at least 10 days before the start of the stay. It is the Client's responsibility to make the request to the Campsite by registered mail with acknowledgment of receipt to the Campsite's address or by sending an email to contact@campingcalmeetnature.com. The Campsite will endeavor to do everything possible to grant the request depending on availability and applicable rates. If the modification is not possible or accepted, the Client must carry out their stay under the initially planned conditions or cancel it.

Article 9. Cancellation of Stay (outside the framework of cancellation/interruption insurance)
9.1 Cancellation by the Campsite
Except in cases of force majeure, the stay will be fully refunded. This cancellation cannot, under any circumstances, give rise to the payment of damages and interests.

9.2 Total or Partial Cancellation by the Client
It is the Client's responsibility to notify the Campsite by registered mail with acknowledgment of receipt to the Campsite's address or by sending an email with acknowledgment of receipt to the following address: contact@campingcalmeetnature.com.
The date of receipt of this written notification will determine the applicable cancellation fees according to the scale below. In the absence of any written notification received under the aforementioned conditions, the Client remains liable for the payment of all sums due for the reservation.

The applicable cancellation fee scale is as follows:

• More than 15 days before the arrival date: The deposit (the 30% arrhes paid at the time of reservation) is fully retained by the Campsite and does not give rise to any refund. If the Client has already paid an amount higher than this 30%, the surplus will be returned to them, minus the booking fees.
• Less than 15 days before the arrival date: The entirety of the total amount of the stay (100%) is due to the Campsite. No refund or compensation will be made.

Non-refundable fees: Regardless of the cancellation date chosen, the €20 booking fees remain billed and acquired by the Campsite. Any fees for subscribing to the cancellation/interruption insurance are never refundable.
The Campsite offers an optional paid Cancellation and Stay Interruption Insurance, through its partner Gritchen Tolède & Associés - Société de courtage en assurances (HEAD OFFICE: 27 Rue Charles Durand - CS 70139 - 18021 BOURGES Cedex).

In case of payment by ANCV holiday vouchers: In the event that a cancellation more than 15 days prior to arrival entitles the client to a partial refund (only if the client had paid more than the required 30% deposit) and this payment was made using ANCV Holiday Vouchers (paper or Connect format), the refund will be subject to a deduction corresponding to the commission fees applied by the ANCV, i.e., 2.5% of the refunded amount. No refund in cash or bank transfer can be made on the portion of the deposit retained by the campsite.

Article 10. Conduct of the Stay
10.1 Arrival and Departure Times
Pitches: Arrivals are from 1:00 PM and departures before 12:00 PM.
Rental accommodations: Accommodations are available from 3:00 PM and must be vacated on the day of your departure by 10:00 AM at the latest.
In the event that a Client is unable to respect the arrival times, it is their responsibility to immediately contact Reception to try to find a solution. In the event of a no-show within 24 hours following the scheduled arrival date and without written notification addressed to the Campsite establishing a certain date, the Campsite reserves the right to put the accommodation / pitch back up for sale. No refund or compensation will be made. No discount will be made in the event of late arrival or early departure. In the event of a delay in handing over the keys / vacating the pitch, an additional night may be billed.

10.2 Check-in / Check-out
Check-in – Upon arrival, Reception checks the client's balance. The Client must have paid the full balance, present an official and valid ID, and deposit the security deposit under the conditions set out above. After registering the Client's arrival, Reception will hand over the keys to the rental accommodation and regulatory information. It is the Client's responsibility to check the inventory upon arrival and report any non-conformity on the day of arrival.
Check-out – It is the Client's responsibility to return their accommodation in a perfect state of cleanliness before 10:00 AM. Otherwise, restoration fees corresponding to the amount of the cleaning fee may be withheld. Similarly, any object broken, lost, or damaged during the stay may be billed to the Client. The security deposit will be returned under the conditions set out above.

10.3 Internal Regulations
During the stay, the Client agrees to respect the internal regulations of the Campsite, which are available / displayed at reception as well as on the Campsite's website. These rules apply to any person residing with them or under their responsibility. Unless otherwise stated in the Campsite's internal regulations or with express authorization from the Campsite, setting up a tent on rental accommodation pitches is prohibited. In the event of a clear failure to comply with these regulations, the Site Director may take sanctions up to the termination of the contract, especially in the event of a disruptive attitude contrary to the calm and serenity of the facility, or in the event of violent behavior, insulting, racist, or threatening remarks made against other Clients, Campsite staff, or its partners or suppliers. The Client is informed that access to the accommodation may also be refused.

10.4 Animals
1 domestic animal is admitted per rental accommodation or pitch, provided it is declared at the time of reservation or upon arrival on site. Domestic animals cannot roam freely and must be kept on a leash, including on the rented pitch. They are not admitted to the sanitary blocks. Animal waste must be picked up by the Client, and their behavior must not harm the peace of other clients. The Client is requested not to leave their dog alone. The admission of animals is subject to two conditions: - valid rabies vaccination - identification by tattoo or chip certified by a card issued by the Société Centrale Canine. The client must bring the animal's health record. Dangerous or aggressive animals (including 1st and 2nd category dogs) as well as exotic animals are not accepted.

10.5 Visitors
Any visitor invited by the Client must be declared and registered at the Campsite Reception. The Campsite reserves the right to refuse them access to the Campsite's services. The Visitor is required to respect the Campsite Regulations. For any visitor aged 7 and over, staying more than 2 hours on the campsite, a fee must be paid. Its amount is fixed according to the current tariff. For less than 2 hours, visitors are admitted free of charge to the site. Their vehicle is prohibited inside the campsite and must remain in the common parking lot.

10.6 Electrical/Gas/Flame Appliances
Any electrical, gas, or open flame accessory brought by clients without authorization is prohibited within the establishment due to fire hazards.

Article 11. Liability
Open-air hotel business does not fall within the scope of hotel keepers' liability provided for in Article 1952 of the French Civil Code. Consequently, the Campsite's liability cannot be held engaged in the event of loss, theft, or damage to personal effects, whether in the Campsite, parking lots, or collective premises (bike room, sanitaries…). It is specified that parking is at the Client's own risk. The Client is required to hold a civil liability insurance policy and should contact their usual insurer to extend the guarantees of their comprehensive housing insurance to the occupied accommodation for the duration of the stay.
The Company has, for all stages of access to the Website, the reservation process, and subsequent services, only an obligation of means. Although the Campsite makes its best effort to maintain an operational service, it cannot offer any guarantee regarding the continuity of access to its Website and consequently declines all liability for any direct and/or indirect damage caused due to the impossibility of accessing it in whole or in part, or which may arise from the use of the service by an internet user.
The Campsite cannot be held criminally or civilly liable for consequences resulting from inappropriate or unauthorized use of the Website or its content by users or any other third party.
The Campsite cannot be held liable for the communication by any third party of photographs for which they declared they held the rights, or for false, misleading, or incorrect information mentioned on the Website concerning the Campsite, notably presentation photos, descriptions, activities, leisure, services, and operating dates. The Campsite cannot be held liable for the non-performance or poor performance of the contract concluded, in the event of a fault by the Client, in cases of force majeure, or due to the unpredictable and insurmountable act of a third party foreign to the provision of the services provided for in the contract. In any case, in the event that the Campsite is found liable for any reason whatsoever, any possible compensation would be limited to the amount of the stay.

Article 12. Complaints
Any complaint must be reported by the Client during their stay to the Campsite so that the latter can remedy the non-conformity or note it. If the non-conformity could not be resolved on site, the Client can send a written complaint to Customer Service so that the latter can attempt to remedy it. In order to best review the complaint, the Client is requested to provide as soon as possible all factual elements (photographs, videos, in particular) that they can gather, unless the non-conformity was noted on site by the Campsite. Any complaint relating to the Client's stay must be sent by mail to the Campsite's address or by email to contact@camping-lacolle.com. No complaint will be taken into account for an incident that was not reported to the Campsite Manager during the stay.

Article 13. Protection of Personal Data
As part of the reservations made by clients of the Establishment via the SecureHoliday Reservation Interface, we collect Personal Data from them at the time of their reservation and then transmit it to the Payment Provider or to the Establishment (via its PMS management software if a PMS gateway is installed) through a technical means determined by the Establishment and for which it is responsible, notably regarding the safety and security of Personal Data.
We then integrate this Personal Data into the database of the SecureHoliday system. The Data collected includes the last names and first names of the clients, their date of birth, their addresses (street, postal code, city, country), their telephone numbers, their email addresses, and the location and dates of their reservations.
All of this information is considered confidential by the Company. It is used solely by the internal services of Calme et Nature for processing the Client's request and for strengthening and personalizing communication and the service offer reserved for Clients.

Article 14. Image Rights Authorization
During their stay, the Client as well as the persons accommodated with them (hereinafter the 'Accommodated Persons') are likely to be photographed or filmed within the Campsite as part of group shots (hereinafter the 'Images'), which the Client accepts on their own behalf and on behalf of the Accommodated Persons. The Client also authorizes, on their own behalf and on behalf of the Accommodated Persons, the Campsite to broadcast the Images on their social networks for a maximum duration of 5 years from the acceptance of these General Terms and Conditions of Sale.
In any case, it is understood that the Client and the Accommodated Persons:

• May withdraw the above authorizations by indicating it, in writing, at the Campsite reception during their stay;
• After the publication of the Images concerning them on social networks, may request their removal by sending an email to the following address: contact@camping-lacolle.com;
• Will receive no remuneration for the broadcasting of the Images as provided for in this Article 14.

Article 15. Applicable Law, Jurisdiction, and Mediation
These General Terms and Conditions of Sale are subject to French law, and any dispute relating to their application falls within the competence of the Courts of Toulon, regardless of the Client's country of origin. In the event of a complaint and after having contacted the Campsite's Customer Service in accordance with the Complaint procedure, the Client has the option to contact a consumer mediator within a maximum period of one year from the date of the written complaint, sent by registered mail with acknowledgment of receipt (LRAR) to the operator.
The coordinates of the mediator likely to be contacted by the Client are as follows: Le CMAP (Centre de Médiation et d'Arbitrage de Paris – CCI de Paris) www.cmap.fr. In application of the provisions of Article 1368 of the French Civil Code, it is expressly agreed that data stored in the information system of the Company and/or its partners has probative force. Thus, data on computer or electronic media stored in this way, if produced as a means of proof by the Company in any litigation or other procedure, will be admissible, valid, and enforceable between the parties.

Article 16. Partial Invalidity of the General Terms and Conditions of Sale
In the event that one of the clauses of these General Terms and Conditions of Sale is found to be null and void due to a change in legislation, regulation, or by a court decision, this shall in no way affect the validity and compliance with these General Terms and Conditions of Sale.
